Terms of Service for photographers
Archived version. This is the text in force on 24 September 2026. The current version.
Correction (25 September 2026). The company named below as FrameDrop, Inc. is Magic Image Solutions LLC, a Delaware limited liability company (8 The Green, Suite A, Dover, DE 19901), which operates FrameDrop and Magic Gallery. Nothing else in this text is changed.
These terms are the contract between you, a photographer using the FrameDrop app and Magic Gallery, and FrameDrop. They cover the app, your account, selling through the platform, and what each of us owes the other. Two separate agreements, the Pro Licensing Agreement and the Machine Data Agreement, cover the re-selling of your photos and the use of your data; they are presented in the app and only bind you if you accept them.
Last updated: 24 September 2026 (the version of 23 September). FrameDrop is FrameDrop, Inc., a Delaware corporation ([registered address]) (“FrameDrop”, “we”). Contact: framedroppro@gmail.com.

1. Acceptance and who may use FrameDrop
By creating an account you accept these terms and confirm you have read the privacy policy. You must be at least 18 and able to enter a contract; if you use FrameDrop for a business, you confirm you can bind that business. You must have an invitation while FrameDrop is invitation-only. Where you are a consumer in the EU, EEA or UK, nothing here removes your mandatory consumer rights.
2. The service
FrameDrop is an app for photographers who sell on the spot: it moves photos from your camera to your phone, shows them to the people you photographed, records sales, delivers the photos by AirDrop, share sheet, email or an online gallery at Magic Gallery, and lets clients buy more later. We may add, change or remove features; where a change materially reduces what you paid for, you may end a paid plan and be refunded the unused part.
3. Your account
One account per person; you may use it on more than one of your own devices. Give us accurate details and keep them current. You are responsible for what happens under your account and for keeping your phone and sign-in code safe; tell us at once if you think someone else has used it. We may suspend an account that appears compromised, that breaks these terms, or where the law requires.
4. Your photos and the licence you give us
You keep the copyright to everything you upload. You give FrameDrop a worldwide, non-exclusive, royalty-free licence to store, copy, resize, watermark, transmit and display your photos and related data as needed to run the service for you: to show them to clients, build galleries, deliver files, render previews, keep the backups you switch on and produce the products a client orders. This licence lasts as long as the content is in the service and for a short period afterwards for backups. For a photo session a client has paid for and received, it also continues after your account closes, for as long as that client keeps the session, and only so that FrameDrop can go on showing and delivering those photos to that client (section 13). It does not include re-selling your photos or licensing them to third parties; that is the separate Pro Licensing Agreement, which is optional and priced.
You warrant that you own or have the rights to upload what you upload and that it does not infringe anyone's copyright, trademark, privacy or other rights.
5. The people you photograph
You are the one with the camera, so you are responsible for the people in your photos:
- You will only photograph, show and sell photos of people in ways that are lawful where you are, and you will honour a request from a person not to be photographed or to have their photos deleted.
- Where the law requires a person's consent to photograph them, to keep their contact details, or to sell products showing their likeness, you will obtain it. Merchandise showing a person is only ever offered to that person unless you hold a written release.
- Face grouping. The app can group photos by face on your phone. Some places treat this as biometric data that needs the person's written consent first (Illinois, Texas and Washington in the United States among them; and the EU, where it is special-category data). In those places keep EU-safe mode on, or obtain consent before you use grouping. You are the controller of that data; we never receive it.
- You will use a client's email address and phone number only to deliver what they asked for and for the follow-up emails the app sends with an unsubscribe link, and you will act on an unsubscribe or a deletion request at once. The app does this for you when the request comes through us.
- You will not photograph children for sale without a parent or guardian present and agreeing.
You will indemnify FrameDrop for claims from people you photographed that arise from your breach of this section.
6. Acceptable use
Do not use FrameDrop for anything unlawful, to harass anyone, to upload material you have no right to, to upload sexual content involving minors (which we report), or to send unsolicited email. Do not reverse-engineer the app, attack the service, scrape it, or use it to build a competing product. Do not share an account or an invitation code publicly. We may remove content and suspend or close accounts that break this section, and we may report unlawful activity.
7. Selling through Magic Gallery
Two ways. (a) FrameDrop's shop: FrameDrop is the seller of record to the client, sells on your behalf at the prices you set, collects the money, handles tax where it is the seller, and credits your share to your earnings balance. (b) Your own shop: you open a Stripe account through the app, you are the seller of record, payment goes to your Stripe account directly, and you accept the Stripe Connected Account Agreement. Your own shop is a paid feature (section 8).
Prices are yours to set in both cases. Refunds to clients follow the client terms; where a refund is owed on a sale in FrameDrop's shop, your share of it is reversed from your balance. Where you are the seller, you handle refunds and disputes and Stripe's rules on chargebacks apply to you.
Merchandise. Where the platform offers printed products, the product page names the seller and the fulfilment partner; the client terms govern the client's purchase, and your share is as stated in the app when the feature is on.
Taxes. You are responsible for income tax on what you earn and, where you are the seller, for any sales tax or VAT. Where FrameDrop is the seller of record it accounts for the tax on that sale. We may have to report what we pay you to tax authorities (for example US Form 1099 or the EU's DAC7 reporting for platform sellers) and may need your tax details before paying out.
8. Fees, plans and payments to you
The split. Sales made through Magic Gallery are shared 50/50 between you and FrameDrop after payment processing costs and any tax that FrameDrop must account for, unless the app shows a different rate for a feature when you turn it on. Sales you make in person, and take payment for yourself, are entirely yours; FrameDrop takes nothing from them.
Plans. The app tells you what is free and what is paid, and the price, before you commit. Paid plans are billed through Apple's in-app purchase and are governed by Apple's terms for cancellation and refunds; a plan renews until you cancel it in your Apple subscriptions. Prices may change with at least 30 days' notice; the change applies from your next renewal. EU, EEA and UK consumers: by starting a paid plan you ask us to begin the service immediately and acknowledge that the 14-day withdrawal right is lost for the part already supplied.
Payouts. Your earnings balance is paid to you through Stripe, in the currency and on the schedule shown in the app, once it reaches the minimum shown and once any identity and tax information Stripe or the law requires is complete. We may hold or reverse amounts that are subject to a refund, a dispute, suspected fraud, or a legal requirement. Balances that cannot be paid because you did not provide the information needed remain available for 12 months after your account closes, then are forfeited to the extent the law allows.
9. Data protection
How we handle your own data is in the photographer privacy policy. For your clients' data (their photos, contact details and deliveries), you are the controller and FrameDrop is your processor; the Data Processing Agreement [to be published] sets out our obligations, our sub-processors and the transfer mechanisms, and forms part of these terms. You are responsible for having a lawful basis to collect your clients' data and for informing them; the app's checkout copy and the client privacy policy help with that but do not replace your own obligations under the law where you work. When you close your account, FrameDrop becomes the controller of the sessions it keeps for your clients under section 13.
10. Testing and changes to the app
We continually test how photos are presented to clients, which means the size of elements, colours, fonts, the order of things and the wording your clients see may change from shift to shift and differ from what another photographer sees. That is by design and is not a fault. We also record how clients react (which photos are shown, kept and bought) as part of running and improving the service; what is done with that beyond running the service is governed by the Machine Data Agreement, which is optional.
11. Third-party services
The app works with services we do not control: Apple (the App Store, AirDrop, in-app purchase), Stripe (payments and payouts), Square, SumUp and other payment apps you may hand a sale to, your camera maker's software, Cloudflare, Supabase and Resend (hosting and email). Their terms apply to your use of them, and we are not responsible for their availability or acts. Handing a sale to a payment app you chose is your transaction with that app.
12. Intellectual property and feedback
The app, the site, their code, design, names and marks are FrameDrop's or its licensors' and are licensed to you, not sold, for use under these terms. If you send us ideas or feedback, we may use them without obligation to you, and you confirm you have the right to give them.
13. Ending the agreement
You may close your account at any time in the app (Settings → Account → Delete my account); that deletes everything we hold for it except records we must keep by law (sales and payouts, without contact details); photo sessions paid for by and delivered to your clients, which stay available to those clients, without your name, until they choose to delete them; and backups, which roll off within 14 days. Before you do, export or deliver what you need; deleted content cannot be restored. We may close or suspend your account with notice if you break these terms, if the law requires, or if we stop offering the service (in which case we give at least 30 days' notice and pay out any balance). Sections 4 (for the wind-down period, and for sessions your clients paid for and received), 5, 8 (for amounts owed), 12, 15 and 16 survive.
14. Disclaimer
FrameDrop is provided as it is and as available. We do not promise it will be uninterrupted, error-free, or compatible with every camera or phone, or that any level of sales will result. Camera links depend on the camera's own software. You are responsible for keeping copies of your photos; the app is a delivery tool, not an archive, unless you have switched on a backup feature and it reports success. EU, EEA and UK consumers: nothing here limits the statutory guarantees you have for paid digital services.
15. Liability and indemnity
To the extent the law allows, neither party is liable to the other for indirect or consequential loss, lost profits, or lost data that could have been backed up, and FrameDrop's total liability to you for everything connected with these terms in any 12-month period is limited to the greater of the fees you paid us in that period and US$100. Nothing limits liability for death or personal injury caused by negligence, fraud, intent or gross negligence, or anything else that cannot be limited under the law that applies to you. You will defend and indemnify FrameDrop against third-party claims arising from your content, your dealings with the people you photograph, your breach of these terms or of the law, except to the extent caused by our own breach.
16. Law and disputes
Talk to us first. Write to framedroppro@gmail.com; we will try to resolve any dispute within 30 days.
If you are a consumer in the EU, EEA, UK or Switzerland (using FrameDrop other than mainly for a business), the law of the country where you live governs, you may bring a claim in its courts, and mandatory protections there stand.
Otherwise, the laws of the State of Delaware, USA govern without regard to conflict-of-law rules. Disputes not settled informally are resolved by binding individual arbitration under the American Arbitration Association's rules (Consumer Rules where they apply), by video or in the county where you live; the Federal Arbitration Act applies. Either party may bring an individual claim in small-claims court, and either may seek an injunction in court for infringement of intellectual property. You and FrameDrop waive jury trial and class or representative proceedings. You may opt out of arbitration by emailing framedroppro@gmail.com within 30 days of creating your account.
17. Changes and the rest
We may change these terms. For changes that matter we give at least 30 days' notice in the app or by email, and you may close your account before they take effect; continuing to use FrameDrop after that date means you accept them. The version in force is the one at this address, dated at the top. Each version stays published at its own address so that what you accepted can always be read. You may not assign these terms; we may assign them to a successor of the business. If a clause is unenforceable the rest stands. Our failure to enforce something is not a waiver. These terms, the privacy policy, the Data Processing Agreement and any agreement you accept in the app are the whole agreement between us about the service. Notices to you go to the email on your account; notices to us go to framedroppro@gmail.com.
